Minimum Wage Posters: Are You Displaying the Right Notices?  

Do you really know what minimum wage posters you have to display around your office? Many employers don’t, and that can lead to penalties. If you’re even slightly unsure, read on. Failing to post required federal, state, and local posters isn’t just a minor oversight—it could cost you. 

Minimum wage posters intend to inform employees about their rights and make sure employers pay their team the federal, state, or local minimum wage (whichever is highest).

What are minimum wage posters?

Minimum wage posters are mandatory notices that display an employee’s rights to the current minimum wage and additional details (e.g., tips). The minimum wage is the minimum amount you must pay an employee when you run payroll.

There are federal, state, and local minimum wage posters. The federal government sets a minimum wage, but states and localities can set a higher minimum wage that you must follow. 

You must display the federal minimum wage poster, which displays an employee’s rights under the Fair Labor Standards Act (FLSA). The federal poster also includes overtime pay, child labor, tip credit, and pump at work requirements. 

Many states and local governments also have posting requirements. Check with your state to find out if you need to display the state minimum wage poster. Consult your locality to see if you need to display a local minimum wage poster. 

Is the employer required by the FLSA to display a poster?

Yes, every employer of employees subject to the Fair Labor Standard Act’s minimum wage law must display the federal minimum wage poster. 

You must post the FLSA/minimum wage poster even if you must post a state and/or local minimum wage poster. The FLSA minimum wage poster contains additional regulations beyond minimum wage, such as overtime rules. 

Where should you display minimum wage posters?

You must display federal and any required state and local minimum wage posters in a prominent place. 

The Department of Labor states that you must post and keep posted the federal minimum wage poster in a “conspicuous place in all of [your] establishments so as to permit employees to readily read it.” 

Examples of where you can display posters on-site may include:

  • Employee break rooms
  • Entrances or common areas
  • HR offices
  • Near time clocks

What if you have remote employees? This is a big one in today’s world! There are electronic labor law poster requirements. You must display posters in a conspicuous place electronically and give employees access to the digital posting (e.g., via an online portal). 

Do I need to get a labor law poster?

Yes, you must obtain and display labor law posters in your business. 

You may need to display federal, state, and local minimum wage posters, along with other labor law posters, like the Family and Medical Leave Act (FMLA).

How do I know if my labor law posters are current? 

Each minimum wage poster includes a “revised” or “publication” date. Typically, you can find this in the bottom corner. Compare this date to the latest information available from the federal, state, or local government. 

For example, the current federal minimum wage poster says “REV 04/23” in the bottom right corner. Cross reference this date with the Department of Labor’s website, which states “Poster last revised: April 2023.” This verifies that this is the most recent version of the poster. 

Replace your federal poster if your poster has a date earlier than April 2023. 

Do you have to display minimum wage posters in multiple languages?

The Department of Labor does not require posting the federal minimum wage poster in Spanish or other languages. However, the DOL encourages posting in multiple languages if your employees speak other languages. 

States and localities may require that you display posters in multiple languages. Check with your state and locality for more information.

Each year, verify that you have the most current version of your labor law posters. If there is a new version, update your display with the new one.

State minimum wage posters

Many states (and cities) set their own minimum wage that is higher than the federal wage. If the state minimum wage is higher than the federal rate, you must follow it and display the state minimum wage poster. 

State minimum wage posters typically tell you who it applies to, aka whether you need to display the poster. Again, you must display the state minimum wage poster alongside the federal minimum wage poster. 

You may be subject to penalties if you do not post your state minimum wage poster. Check with your state about specific posting requirements.

Local minimum wage posters

Several localities (cities and counties) set a higher local minimum wage than the federal and state rights. 

Your locality may require you to display a local minimum wage poster. For example, San Francisco has a minimum wage poster that employers must display. 

You may be subject to penalties if you fail to post your local minimum wage poster. Check with your locality for more information.
