Minnesota employers looking for payroll software can count on Patriot PAY to stay up-to-date on the laws and rules for Minnesota businesses:


  • Withholding Requirements -- Employers must register as an employer in Minnesota by filing Form MDES-13 (Report to Determine Liability).

    Before starting work, employees must fill out the Employee Withholding Form W-4MN, which is available online.

    The supplemental income tax rate in Minnesota is 6.25%.

  • State Unemployment Insurance (SUI) -- Minnesota employers must report quarterly wages and contributions by filing Form MDES-1D (Employer's Quarterly Wage Detail report) and Form MDES-1 (Employer's Unemployment Quarterly Tax Report) by the last day of the month following the end of the quarter.

    The wage base for SUI is the first $27,000 paid to each employee.

    Rates range from 0.7014% to 11.05032%; new employers are assigned a rate of 2.91%, and new employers in a high-experience rating industry must use a rate of 9.4%.

    For all employers, there is a special assessment of 14% of tax due.

    A Workforce Enhancement fee assessment of 0.10% is also not included in these rates.

  • Minimum Wage Laws -- The Federal minimum wage rate applies in Minnesota.

  • Termination Pay -- If an employee is fired, their pay is due immediately. If the employee quits, their paycheck is due by the next regularly scheduled payday, not to exceed 20 days from the last day worked.

  • New Hire Reporting Laws -- Employers must report hiring, rehiring, and employees returning to work within 20 days on Form W-4 (Employee's Withholding Allowance Certificate) and send to:
