New Mexico employers can now have the benefit of online payroll with
Patriot PAY, the cloud-based payroll software from Patriot Software, Inc. Employers can depend on accuracy of their payroll tax calculations, and they can count on
Patriot PAY to stay up to date on current New Mexico regulations, including:
- Withholding requirements -- Employers must register by filing the Form ES-802 Status Report.
Employees should complete the Federal W-4 Employee Withholding Allowance Certificate for New Mexico withholding.
Employers should follow the formula as their withholding method.
For supplemental wages, employers should withhold at the 4.9% flat federal rate.
- State Unemployment Insurance (SUI) -- The current wage base is $21,900 for 2011, and will be $22,400 for 2012.
Rates for SUI range from 0.05% to 5.40%.
New employers should use a starting rate of 2%.
- State Disability Insurance (SDI) -- Employers should complete the Form-WC-1 (Workers' Compensation Personnel Assessment) by the last day of month following end of quarter and mail to:

Employers pay $2 per employee per quarter for SDI, and effective the quarter ending Sept. 30, 2011, $2.30. Employees also contribute
$2 per quarter to the fund.
- State Labor Laws -- The minimum wage is currently $7.50 (as of 11/21/11).
If an employee is fired, they should receive their final termination pay within five days. If they quit, they should receive their payment on the next regular payday.
- New Hire Reporting -- Employers must report hiring, rehiring, and return to work within 20 days on Form W-4 (or equivalent) to:
