Mississippi employers can rely on
Patriot PAY to stay current on the latest payroll tax information and state laws affecting Mississippi small business owners.
- Withholding Requirements -- All Mississippi employers must register for an employer identification number for state withholding by filing Form 70-001 (Registration Application). To file online, click here.
Employees who are exempt from withholding must file a Mississippi Employee's Withholding Exemption Certificate - Form 89-350.
Mississippi employers must follow these rules for Supplemental Rates. If they do not withhold tax from regular wages for an employee, they should add the supplemental rate to their regular wages for the current or preceding payroll period and withhold on the total. If they do withhold tax from the regular wages, they should add the supplemental tax to the regular wages, compute the tax on the total, and subtract the tax withheld on the regular wages.
- State Unemployment Insurance (SUI) -- The wage base for each employee is the first $14,000 earned.
Rates for SUI range from 0.85% to 5.40, and include the 0.3% workforce training enhancement tax.
New employers are assigned a rate of 1.15%.

- State Labor Laws -- The federal minimum wage rate ($7.25) applies as of 7/20/2011.
Mississippi makes no provision for the payment of termination wages to employees.
- New Hire Reporting --Employers must report hiring, rehiring, and employees returning to work within 15 days on Form MDHS-DCSE-6700. Employers can find more info at the Mississippi State Directory of New Hires.
- Work Opportunity Tax Credit -- Mississippi offers the WOTC to employers who hire persons from within the following "target groups": Short-term welfare recipients, veterans, ex-felons, designated community residents, vocational rehabilitation referrals, summer youth, Food Stamp recipients, SSI recipients, & long-term family assistance recipients.
